Terms and conditions
These conditions govern the purchase and use of eximius card: a physical NFC card and the personal page (landing) it points to. By requesting or using the product you accept what follows. They are written to be understood; if anything is unclear, write to us before buying.

1. Who we are
eximius card is a product of Steven Miguel Pesantes Egas, a sole trader with tax ID (RUC) 0931233183001, based at Parque Empresarial Colón, Ecuador. In this document we refer to ourselves as «eximius studio» or «we», and to you as «the client» or «you».

2. What the product includes
When you buy eximius card you receive:
- A metallic NFC card engraved with your page address.
- A personal page hosted by us, reachable at that address.
- Access to a dashboard to edit your page content whenever you want.
- A contact file (vCard) downloadable from your page.
- A usage guide and direct support during setup.
The card works by holding it near a phone with NFC enabled. No app is required, but the phone needs an internet connection to load the page. Compatibility depends on the recipient's phone, not on us.
3. How the process works
eximius card is not a self-service product: every card is manufactured and configured for you.

There is no public sign-up on the platform. We create accounts ourselves when manufacturing your card, because your page address is permanently engraved on the chip.
4. Prices and payment
The price depends on the number of cards and the level of customisation. It is given in a quote before any charge. Prices are stated in United States dollars and include applicable taxes where indicated.
Production starts once the agreed payment is confirmed. Unless otherwise agreed in writing, payment for the product is one-off: there is no subscription or recurring charge for keeping your page online.
5. Delivery times
Activation of your page happens within 24 to 48 business hours from the moment you confirm the final content. The manufacturing and shipping time for the physical card is separate and is stated in the quote, as it depends on the finish, the quantity and your location.
Timelines are good-faith estimates. Delays from manufacturing suppliers, shipping or customs may affect them; we will tell you if that happens.
6. Your page and your address
Your page lives at an address in the format /@your-name. That address is chosen during setup and engraved on the NFC chip.
The address cannot be changed once the card is manufactured. The chip points to that URL permanently; changing it would leave the physical card pointing at a page that does not exist. If you need a different address, a new card must be made.
Addresses are assigned in order of purchase. If the one you want is taken, we will propose alternatives before manufacturing.
7. Content you publish
Your page is public: anyone with the link or with physical access to your card can see it. Do not publish anything there that you would not want third parties to see.
You are responsible for the content you upload. It is not permitted to publish:
- Unlawful content, or content infringing third-party rights (trademarks, images, text).
- Other people's personal data without their consent.
- Misleading or fraudulent material, or material impersonating another person or organisation.
- Sexually explicit or violent content, or content inciting hatred.
- Malicious software or links to it.
If we detect a serious breach we may suspend the page, telling you and giving you the chance to fix it, unless urgency or the law require immediate action.
8. Content updates
You can edit your page content as many times as you want from your dashboard, at no extra cost: text, links, images, block order, contact details.
This covers content, not redesign. Custom visual structure changes, new templates or specific development are quoted separately.
9. Card warranty
The card carries a 12-month warranty against manufacturing defects from delivery. If the chip stops responding or the finish shows an original defect, we replace it at no cost.
The warranty does not cover:
- Physical damage from impact, bending, heat, water or normal wear.
- Loss or theft of the card.
- Incompatibility or NFC disabled on a third party's phone.
- Internet connection failures on the device reading it.
This commercial warranty is without prejudice to the rights granted to you by the Consumer Protection Act (Ley Orgánica de Defensa del Consumidor).
10. Service continuity
Your physical card depends on the page staying online. The chip contains a web address; if the service stops being available, the card will show nothing when held near a phone. We want you to know this before buying.
We commit to keeping your page active and to making a reasonable effort to keep it continuously available. Even so, interruptions may occur due to maintenance, failures at our hosting provider or causes beyond our control. We do not guarantee a specific uptime percentage.
If we ever decided to discontinue the service, we would give you at least 90 days notice and hand you a copy of your content so you can move it elsewhere.
11. Cancellations and refunds
You can cancel at no cost before production begins, with a full refund of what was paid.
Once manufacturing has started, since this is a personalised product engraved with your details, no refund applies except for a manufacturing defect (see point 9) or an error attributable to us. If the error was ours, we remake the card at no cost.
You can request removal of your page and deletion of your data at any time by writing to us. That does not entitle you to a refund of a product already delivered.
12. Intellectual property
The eximius card brand, the platform design and its code are ours. Buying the product gives you the right to use them, not to copy or resell them.
The content you upload remains yours. You authorise us solely to host and display it on your page in order to provide the service. We may show your card as an example in our portfolio only if you authorise it in writing.
13. Liability
We are responsible for the correct functioning of the product and the service as described here. We are not responsible for:
- The content you publish or the consequences of publishing it.
- Third-party services you link or embed (calendars, videos, payment gateways).
- Indirect commercial losses arising from a service interruption.
- The use a third party makes of the public information on your page.
Nothing in these conditions limits our liability in cases where the law does not permit limiting it.
14. Changes to these conditions
We may update these conditions. The date of the latest version appears at the top. If a change materially affects you, we will notify the email on your account at least 30 days in advance.
15. Governing law
These conditions are governed by the laws of the Republic of Ecuador. Any dispute will be submitted to the competent courts of [CIUDAD], without prejudice to the consumer's right to use the administrative channels provided by the Consumer Protection Act.
